Our key area of specialisation in the field of reprivatisation relates to Warsaw land that was taken over under the Decree on ownership and use of the land in the territory of the Capital City of Warsaw of 26 October 1945 (Journal. of Laws, No. 50, item 279), the so-called "Bierut Decree". In particular, we are involved in representing pre-Decree owners or their legal successors in cases relating to the recovery of real estate properties in kind (wherever it is possible) or obtaining compensation for the illegal nationalisation of real estate properties that were thus lost. We also run administration and court-and-administration proceedings (before the WSA and NSA Courts), among others, involving decisions relating to the Decree, the establishment of invalidity of decisions refusing the granting real estate property owners temporary ownership right to the real estate property or decisions allocating residential premises for sales (i.e. the so-called "housing decisions"). We also represent former owners of real estate property also in any proceedings concerning the defence against the unfavourable consequences of administration decisions and civil law actions that followed the nationalisation of real estate properties, i.e. in disputes concerning expenditure and the payment of mesne profits.
