PhD Józef Forystek

Attorney-at-Law and Tax Advisor

Born in 1966. Studied law at Jagiellonian University in 1985-1991. He also simultaneously  studied psychology at Jagiellonian University. He defended his master's dissertation written under the supervision of Prof. Andrzej Zoll in 1991, receiving a very good grade. He completed legal studies with a very good grade, too. A doctoral dissertation, whose promoter was prof. dr hab. Grzegorz Ostasz defended in 2018.

In 1991 he was entered onto the list of barrister trainees of the District Bar Association (ORA) in Kraków. In 1995 he passed the bar exam with a very good grade, being first on the list. He was entered onto the list of barristers in 1995, and in 1997 onto the list of tax advisors and the list of solicitors performing the profession of an attorney-at-law.

In 1993 he completed a traineeship in the English law firm, "PINSENT & CO.", in Birmingham (England). In the years 1995-1996 he worked as the only Polish attorney-at-law in the Anglo-American DEWEY BALLANTINE THEODORE GODDARD (DBTG) operating in Warsaw, and in 1996-1997 in the American law firm DEWEY BALLANTINE (DB). He has been providing legal services since 1995, initially in a one-person law firm, and then as from 1997 as a founder and partner of the law firm of attorneys-at-law and solicitors (Forystek Góralczyk Rychlicki and Forystek Góralczyk Rychlicki Budzowska Fiutowski Jamorski).

Since 2003 he has been a founder and managing partner in FORYSTEK & PARTNERZY - Attorneys-at-Law and solicitors.

While co-operating with foreign law firms he participated in the reorganisation and privatisation of the tobacco industry in Poland, as well as in the acquisition of shares in Polish companies by foreign investors. He also participated in the privatisation of state-owned enterprises and in introducing shares of companies for public trading. He then provided services to Polish and foreign listed companies. For dozens of years he has been involved in providing legal services to the largest foreign banks in Poland.

He specialises in real estate property law and in  economic law, in its broadest sense, with a special focus on banking law and commercial agreements, also in court and arbitration disputes. He has gained extensive professional experience involving appearances before the Supreme Court and the Supreme Administration Court (NSA) in cases relating to cassation appeals. He has won hundreds of cases in these courts, and some before the European Court of Human Rights in Strasbourg. He advises international corporations, represents both Polish and foreign entities and individuals in court and arbitration proceedings. He also has expertise in tax and criminal law since he participated in a seminar run by Prof. Andrzej Zoll.

Since the early 90's he has been representing numerous aristocratic families and former owners of nationalised estates in all kinds of  reprivatisation cases, with special attention given to cases involving Warsaw land and zabużańskie cases. He has been a lecturer in scientific conferences involving reprivatisation issues.

He has been a judge holding many terms of office in the Disciplinary Court of the District Bar Association in Kraków.

He has authored many publications about law. He is a legal expert and commentator in the so-called yellow (legal) pages in the Rzeczpospolita daily.

He speaks English.
